Terms and Conditions

 HOMEGEAR DESIGNS

• False ceiling work and electrical point relocation
• Builder-imposed restrictions on work hours
• Ongoing third-party work (e.g., painting, wallpapering, flooring, or carpentry) during installation
• Post-order design changes or additional orders
• If occupants are residing at the property during installation
• External delays such as power outages, non-functional lifts, or lack of necessary permissions
• Force majeure events

Additional Exclusions:

• Hardware/appliances that are non-functional at delivery: replacements are free, but timeline depends on availability
• Deep scratches on shutters (only replaced if not removable by polishing)
• Shade variations in shutter finishes
• Projects where woodwork component is equal to or exceeds INR 15 lakhs

If Homegear is in material breach of the 60-day timeline, and the guarantee applies, compensation will be paid at INR 1,000 per 5-day delay, capped at INR 30,000.

Example: If handover occurs on Day 66, compensation = INR 5,000.

3. PAYMENT FOR SERVICES

The total cost (“Price”) shall be as per the official quotation shared by Homegear and accepted by you.

Payment Milestones:`

• 10% upon booking the order
• 40% within 2 working days of final design approval (before manufacturing starts)
• 40% upon dispatch of woodwork to site
• 10%Once complete work  is done

Delayed payments may lead to delays in project execution. Homegear will not be liable for such delays.

4. WARRANTY AND DISCLAIMER

Warranty Coverage:

In case of any manufacturing defect, Homegear will, at its discretion, repair or replace the affected products within the warranty period, as per Annexure 2.

Products Covered:

• Laminated plywood cabinets – 10 years
• Shutters (block board) – 5 years
• Accessories, hardware, appliances – As per manufacturer warranty
• False ceiling – 1 year

If any alternate material is used (not provided by Homegear), only manufacturer warranty applies.

Warranty Conditions:

• Applicable only for domestic use and proper maintenance
• Not valid for resale or property transfer
• Notification of defect must be given in writing within 7 days of discovery
• Defective items may be repaired or replaced with the closest available match
• Warranty is void if unauthorized personnel alter or repair the products

Exclusions from Warranty:

• Normal wear and tear (scratches, dents, accidents)
• Rusting of metal parts due to chemicals or cleaning agents
• Water seepage or dampness (for non-BWP plywood beyond 72 hours)
• Discoloration due to light, heat, or environment
• Use of harsh cleaning agents
• Mishandling, improper care, or outdoor use
• Alterations or use inconsistent with product instructions
• Force majeure or environmental damage
• Product removal after installation

Service warranty is applicable for the first 6 months post-installation. After this period, services are chargeable. No service will be provided if any payment is pending.

5. LIMITATION OF LIABILITY

Homegear, its affiliates, vendors, or subcontractors shall not be liable for indirect, incidental, or consequential damages.

Maximum liability shall not exceed the actual amount paid by you for the specific service or product in question.

6. FORCE MAJEURE

Homegear shall not be held liable for delays or failure in performance due to causes beyond its reasonable control, including but not limited to:

• Machinery breakdown
• Material shortages
• Strikes or labor issues
• Acts of God, riots, war, civil unrest

If such conditions persist, the engagement may be terminated by mutual agreement.

7. CANCELLATION POLICY

• This engagement may not be unilaterally terminated.
• If payment is delayed, Homegear may suspend services without refunding any amount already paid.
• If you cancel after agreeing to these terms, all payments made are non-refundable, and you will remain liable for the balance payment as compensation (not as penalty) for losses incurred.

8. GOVERNING LAW & JURISDICTION

These terms shall be governed by the laws of India, and all disputes shall fall under the exclusive jurisdiction of the courts of Bangalore.
